Liability Waiver & Assumption of Risk

1. Program Overview

Roots and Wings WNC (“the Program”) is an outdoor, faith-based enrichment program for children and families held in Western North Carolina. The Program is currently operated by an individual organizer under the program name Roots and Wings WNC and is not described here as a separate legal entity. Activities take place outdoors on private property and may include nature exploration, crafts, gross motor play, group activities, and unstructured free play.

The Program is structured as a parent-present family program, not a drop-off program. A parent or legal guardian is expected to remain on-site throughout each session and retains primary responsibility for supervising their child(ren).

2. Assumption of Risk

I, the undersigned parent or legal guardian, understand and acknowledge that participation in the Program involves inherent risks associated with outdoor activities on private property. These risks include, but are not limited to:

• Uneven terrain, natural obstacles, wildlife, insects, and weather exposure
• Physical activities such as running, climbing, and exploration that may result in falls, scrapes, bruises, or other injuries
• Exposure to allergens, plants, and other naturally occurring hazards
• Interaction with other children during group activities and free play

I voluntarily assume the inherent risks of participation in the Program and the ordinary risks naturally associated with outdoor family activities on private property. I understand that this document is intended to acknowledge those risks and, to the extent permitted by North Carolina law, to allocate responsibility for ordinary risks of participation. Nothing in this document is intended to release or waive liability for gross negligence, reckless conduct, willful misconduct, criminal acts, or any duty that cannot lawfully be waived under North Carolina law.

3. Release and Waiver of Liability

In consideration of my child(ren)’s participation in the Program, I, on behalf of myself and to the extent permitted by North Carolina law on behalf of my child(ren), acknowledge and agree that any claim relating to ordinary risks of participation shall be limited as stated in this document. This acknowledgment is intended to benefit:

• Roots and Wings WNC, meaning the individual organizer operating under that program name, along with any helpers acting at the organizer’s direction during a session
• The property owner(s) of the location(s) where Program activities are held

This document is intended to apply only to claims arising from ordinary negligence, inherent outdoor risks, and ordinary premises-related risks, to the fullest extent permitted by the laws of the State of North Carolina. It is not intended to release claims based on gross negligence, reckless conduct, willful misconduct, criminal acts, or obligations that North Carolina law does not allow a parent or guardian to waive.

4. Participant Conduct

I agree that my child(ren) will follow the directions of Program leaders and treat all participants, volunteers, and property with respect. The Program reserves the right to dismiss any participant whose behavior poses a safety risk to themselves or others, without refund.

5. Supervision

I understand that Roots and Wings WNC is primarily a parent-led program. Parents and guardians are expected to remain on-site and maintain responsibility for supervising their child(ren) at all times unless alternative arrangements have been specifically discussed and agreed upon with Program leaders.

6. Injury Reporting

I agree to promptly report any injury, illness, or safety concern that occurs during a Program session to a Program leader. I understand that Program leaders will make reasonable efforts to notify me of any incident involving my child(ren) but are not medical professionals.

7. Private Property Acknowledgment

I understand that Program activities take place on private property and that the property may not be inspected or maintained to the standard of a public facility. I acknowledge the presence of naturally occurring outdoor conditions and accept the ordinary inherent risks that come with using private outdoor property for family activities. I also understand that this acknowledgment does not excuse the organizer or property owner from responsibilities that cannot be waived under North Carolina law.

8. Governing Law

This waiver shall be governed by and construed in accordance with the laws of the State of North Carolina. If any provision of this waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.

9. Acknowledgment

By completing the Roots and Wings WNC registration form, I confirm that I have read, understood, and agree to this Liability Waiver & Assumption of Risk. I am the parent or legal guardian of the child(ren) being registered, I will remain on-site during each session unless otherwise agreed in writing, and I have the legal authority to agree to these terms on their behalf.
